This appeal originated in an action brought by the plaintiff to impress a trust upon certain real property held of record in the name of the defendant. Defendant's demurrer to plaintiff's amended complaint was sustained and thereafter the plaintiff declined to amend and upon motion made by defendant a judgment of dismissal was made and entered, from which plaintiff appeals.
