The plaintiff instituted this action as a result of injuries he received while incarcerated in the jail of the Town of Basile. A direct action was filed against the town's insurer in East Baton Rouge Parish. The defendant insurer, Zurich-American Insurance Company, filed an exception of no right and/or no cause of action.
