The offense is felony theft; the punishment, enhanced under Art. 63, Vernon's Ann.P.C. by two prior convictions for felonies less than capital, is life imprisonment.

In 1953, appellant was convicted for theft of an automobile. He subsequently filed application for writ of habeas corpus in the District Court of the United States, Eastern District of Texas, alleging that he was without benefit of counsel at the time he was sentenced...
