1. There was evidence before the court that one Jackson on May 4, 1963, drew a check for $4,335 on his account in the defendant bank payable to the plaintiff. The plaintiff presented this check to the bank on June 26, 1963, and was informed that there were insufficient funds on deposit in the drawer's account to pay the check.
