PER CURIAM.

Defendant was convicted of murder in the first degree, and the jury not recommending life imprisonment, he was sentenced to death. He appeals directly to this Court pursuant to R.R. 1:2-1(c).

The judgment must be reversed and the matter remanded for retrial by reason of Griffin v. State of California, 380 U.S. 609
