The Central Trust Company, as trustee of a trust created under the will of James Maxwell, deceased, has filed a petition for the construction of said decedent's will which, after making a number of bequests, provides, in Item IX, for the aforementioned trust of the decedent's residuary estate, which said item, in part, reads as follows:

"I direct that my trustees shall hold in trust my residuary estate...
