This case was referred pursuant to Rule 57(a) to Lloyd Fletcher, a trial commissioner of this court, with directions to make findings of fact and recommendations for conclusions of law. The commissioner has done so in an opinion filed July 14, 1964. On August 3, 1964, the plaintiffs filed a motion to adopt the commissioner's report and on August 24, 1964, the defendant filed an election to adopt the commissioner's report.
