This is a suit for damages arising out of a motor vehicle collision which occurred in the Parish of Assumption on October 23, 1948. From an adverse judgment of the trial court, defendants have appealed. In his brief before this court esteemed counsel for appellants suggests dismissal of plaintiff's action for alleged failure to prosecute as provided by LSA-C.C.P. Article 561.
