This is an appeal from a judgment of the District Court for the Northern District of Texas that taxpayer1 take nothing in his suit for refund. The years 1956-1959 inclusive are involved. Ackerman v. United States (D.C.N.D.Tex. 1963) 215 F.Supp. 867. The essential question is whether the taxpayer was holding certain real property, the proceeds from the sale of which are here involved...
