This assumpsit action was instituted by Betty E. Gardiner and Henry G. Gardiner, her husband (Gardiners), in the Court of Common Pleas of Philadelphia County against the Philadelphia Gas Works (Gas Works), for an alleged breach of "agreement, warranty and promise."
