The facts disclosed by the record are virtually without dispute. On December 4, 1959, Vera Weltz, a minor, lost her life in an automobile accident a short distance outside Sandpoint, Idaho, on U. S. Highway No. 95. She was riding in the front seat of a sedan owned and operated by Mr. George Cussen, a teacher from Noxon, Montana, seated between Mr. Cussen and Robert Cluzen.
