This is an action of tort for personal injuries suffered by Richard F. Falvey, a minor, by reason of the alleged negligence of the defendant. The case was referred to an auditor who found for the defendant. Thereafter the case was tried to a jury on the auditor's report and other evidence, and the jury returned a verdict for the plaintiff, which was recorded under leave reserved. On motion of the defendant the judge entered a verdict for the defendant...
