HOLMES, Justice.

In this case the plaintiffs in error, hereinafter referred to as defendants, were convicted of assault with intent to commit murder in the second degree. The jury fixed the punishment of each defendant at imprisonment in the County Jail for eleven months and twenty-nine days and a fine of $500.00.
