The plaintiff instituted this suit against the defendant seeking to recover $6,000.00, representing the face value of a certain fire insurance policy issued by the defendant, covering the furniture and personal effects belonging to plaintiff and his wife, together with 12% penalties and attorneys fees of $3000.00 for defendant's arbitrary and capricious refusal to pay plaintiff's claim plus legal interest on the total amount.
