This is an action for damages alleged to have been sustained by plaintiff-respondent, Charles Peters, as the result of the defendants-appellants Lee and Isal Shull, having changed the grading and having raised the elevation of portions of their adjoining lot causing surface waters to be artificially collected and discharged in a body on plaintiff's lot and house causing it to be permanently damaged.
