This is a rear-end automobile collision case. The plaintiffs (appellants), Max M. Flaks and wife, and the defendant (respondent), Lincoln McCurdy, were traveling in the same direction on Highway No. 97, between Yakima and Ellensburg, on the afternoon of November 23, 1960.
