This appeal occurs upon denial of appellant's motion to vacate and set aside a sentence imposed after conviction of Breaking and Entering with Intent to Commit a Felony. Appellant's motion was based upon an alleged denial of the right to counsel and contained factual allegations as to the circumstances surrounding his conviction and sentencing which sufficed to state a prima facie case for relief.
