This is a habeas corpus case challenging the lawfulness of the procedures used in a preliminary hearing. Appellant, an indigent juvenile, was charged with the capital offense of abetting a rape. After the juvenile court waived jurisdiction, he was brought before the United States Commissioner on May 7, 1964,1 for a preliminary hearing to determine whether there was probable cause to believe that an offense had been committed...
