Following trial to a jury, appellant was convicted on Counts Two and Three of a three count indictment charging violations of the "fraud by wire" statute, 18 U.S.C. § 1343 which reads as follows:

"§ 1343. Fraud by wire, radio, or television "Whoever, having devised or intending to devise any scheme or artifice to defraud, or for obtaining money or property by means of false or fraudulent pretenses, representations...
