MARBURY, J., delivered the opinion of the Court.

The appellant, Joseph E. Johnson, Jr., was found guilty by a jury of raping a sixteen year old girl and was sentenced to death in the Circuit Court for Anne Arundel County, the case having been removed from Montgomery County. From the judgment and sentence entered on the verdict he has appealed to this Court. It is a companion case to Giles v. State, 229 Md. 370,
