The complaint alleges that plaintiff had entered into a contract in writing with the Republic of Haiti by the terms of which the latter agreed to sell and plaintiff agreed to buy the premises known as 329 Fifth Avenue for the sum of $240,000. The date of closing provided in the contract, September 9, 1959, was extended to October 7, 1959. Prior to the closing plaintiff offered the premises for sale to the defendants.
