The defendant, Wilbert Harvey, was indicted in the criminal court of Cook County on the charge of selling, possessing and dispensing a narcotic drug. He pleaded not guilty and, after waiving a jury, was tried by the court, found guilty of the unlawful sale of narcotics and sentenced to a term in the penitentiary of not less than 10 years nor more than 11 years.
