This suit was brought by the appellant to recover from appellee Clay the balance due under an executory contract for the sale of land and to foreclose an implied vendor's lien securing its payment. The appellee impleaded the other appellees herein, asserting that if he owed such balance then he was entitled to recover that amount from the other appellees on the theory that he had paid them that amount upon their representation they had acquired...
