This suit was filed by the plaintiff to annul an act of retrocession by her husband, Harry H. Hodges, Jr., to his father, Harry H. Hodges, Sr., and to recognize the plaintiff as the owner of one-half interest in certain community property by virtue of a Declaration of Family Home in accordance with the provisions of LSA-R.S. 9:2802 which provides:
