HOLT, Justice.

The appellant was charged with the offense of permitting gambling. The trial court, sitting as a jury, found the defendant guilty and fixed his punishment at a fine of one hundred dollars and costs and thirty days imprisonment from which judgment comes this appeal.

For reversal appellant adamantly urges only the point that:
