Judgment in favor of plaintiff dated May 18, 1961 unanimously modified, on the law and the facts, to the extent of reducing the recovery to $343.38 plus interest and costs, but in no event in excess of $500, and otherwise affirmed, with costs to defendant.

It is clear that both the issuer of the bond and the attorney who procured its issuance intended that the bond should cover only costs and so understood it. Their interpretation is not negatived with any certainty...
