Judgment reversed on the law, and a new trial granted, without costs, unless, within 30 days after entry of the order hereon, plaintiff shall stipulate to reduce to $4,450 the amount of the verdict in his favor on the first cause of action, in which event the judgment, as so reduced, is affirmed.
