On October 14, 1960 plaintiff filed suit against the defendant, from whom he was legally separated on November 20, 1959 in which he prayed for a judgment declaring an infant child born to the defendant on or about September 15, 1960, named Barbara Fay Singley, he declared and adjudged not to be the child of plaintiff.
