Decree reversed, on the law and the facts, with costs to petitioner, payable out of the estate, and proceeding remitted to the Surrogate's Court for the making of a decree dismissing said respondent's objection and granting the petition. Findings of fact which may be inconsistent herewith are reversed, and new findings are made as indicated herein.
