Under the provisions of LSA-R.S. 13:5062 Plaintiff instituted suit against Defendant to establish his title to certain batture land in the Parish of Lafourche. On the trial of the case it was stipulated by counsel for both parties that neither claimant was in possession of the property, so that the resolution of the issue depends upon the conclusion as to which of the parties to the suit have title to the land in question.
