Mrs. Lydia C. Heintz died testate on November 2, 1951 bequeathing to her son Jared Y. Heintz three-fourths of her one-half interest in the community estate and to her daughter Mrs. Alma S. Heintz Gilbert the remaining one-fourth interest. Her surviving spouse, Charles H.
