This is an action in tort wherein plaintiffs, husband and wife, seek to recover damages—she for personal injuries and he for property damage and medical expenses incurred for treatment of his wife.

The injuries and damages were allegedly sustained in a collision between plaintiffs' automobile, operated at the time by the wife, accompanied by three minor daughters, and the vehicle of the defendant, Eakin, who as the driver, was accompanied...
