The appellee sued appellant and North Side State Bank of Houston to recover $2,150.87 that was on deposit in said bank at the time of the death of Lester O. Nix. The bank tendered the money into court, it having theretofore refused to pay the money to appellee only because of the conflicting claims of appellee and appellant.
