Plaintiff's action ex delicto seeks recovery for damages inflicted upon his pick-up truck which was struck from the rear by an automobile driven by James Henry, the nineteen year old son of H. H. Henry. At the time of the collision on November 11, 1961, about 10:00 P.M., plaintiff's vehicle was stopped temporarily facing east, about one-half of it being parked on the paved surface and one-half on the shoulder of U. S. Highway 80, close to plaintiff...
