These, so far as argued by the defendant, are the defendant's exceptions to the denial of motions for a new trial of an action of tort for injuries to Janice Gilman and the consequential damages of her husband, Richard, and to evidential rulings as well as to a portion of the charge. Janice died July 1, 1961, after suit was brought, and her husband as administrator was substituted as a plaintiff.
