The defendant was indicted for murder in the first degree. At his arraignment on September 6, 1935 he was without counsel. At the direction of the court a plea of "not guilty" was entered. Subsequent thereto counsel was assigned. He made no motions with respect to the indictment. After trial he was convicted as charged and on May 11, 1936 he was sentenced to be executed. The judgment of conviction was affirmed (272 N.Y. 602). Governor...
