This is an appeal from the Circuit Court of Montgomery County from a final decree on a petition in the nature of mandamus in favor of the respondent Guy Sparks as Commissioner of Revenue of Alabama. The Bashinskys seek a reversal of the decision of the lower court, and issuance of a writ in the nature of mandamus to the Commissioner of Revenue requiring that he certify a refund of taxes and interest accrued.
