This action in the District Court for the Southern District of New York, seeking a declaratory judgment of the invalidity of a final order of deportation, was pending undetermined on October 26, 1961, the effective date of P.L. 87-301, 75 Stat. 650. Section 5(a) of that Act amended the Immigration and Nationality Act of 1952, 66 Stat. 163, by adding to it Section 106, 8 U.S.C.A. § 1105a, making the procedure for review in the courts of appeals prescribed...
