Defendant was convicted of murder in the first degree, and the jury not having recommended life imprisonment, he was sentenced to die. N.J.S. 2A:113-4. He appeals directly to us pursuant to R.R. 1:2-1(c).

Defendant did not dispute his guilt. Rather he contended he was so intoxicated that his crime did not exceed murder in the second degree.
