This suit on a building contract, involving an allegedly defective terrazzo floor, was tried twice before a jury. Each trial resulted in a verdict in favor of plaintiff but the first verdict was not made the judgment of the court solely on the grounds that the amount of damages awarded and the dismissal of the reconventional demand did not correspond to the proof.
