The appellant, American Insurance Company, appeals from a judgment of the Circuit Court of Marion County wherein the appellee, Marvin F. Prine, recovered a judgment in the amount of $5,000.

This suit was based upon a fire insurance policy issued by appellant to appellee on March 1, 1960, insuring his home in the amount of $5,000, which was destroyed by fire on January 11, 1961. The record discloses that...
