Defendant was charged with a violation of section 266h, Penal Code and one prior felony conviction. He pleaded not guilty and denied the prior, waived his right to a jury trial and submitted the cause on the transcript of the preliminary hearing. The trial court adjudged defendant guilty, found the prior to be true, denied probation and sentenced him to the state prison. From the judgment defendant appeals.
