This action was brought by appellee under the Indiana Workmen's Compensation Act for injuries allegedly arising out of and in the course of his employment.

The facts, as stipulated by the parties, are that appellee was employed by appellant as a "toll attendant" and as such was required during the winter season to wear a winter uniform.
