Memorandum Findings of Fact and Opinion

FORRESTER, Judge:

Respondent has determined a deficiency in income tax of the petitioners for the taxable year 1955 in the amount of $2,698.24. The only issue presented for our consideration is whether petitioners are entitled to deduct the amount of $10,274.58 paid by petitioner W. O. Pope during 1955 on a judgment against him.

Some of the facts have been stipulated and are so found.
