Appellees filed their complaint for foreclosure of a mortgage against the appellant. In its amended answer, the appellant plead a counter-claim seeking damages from the plaintiffs for breach of warranty. Upon motion, the court dismissed the amended counterclaim and the counter-claimant appeals.
