This is an appeal on questions of law from the Columbus Municipal Court. On May 2, 1960, the defendant, Norman Vincent Mullins, was charged in an affidavit with operating a motor vehicle under the influence of alcohol in violation of Section 2133.01, Traffic Code of the city of Columbus.
