Upon trial by jury in the Circuit Court of Jackson County, at Independence, defendant was found guilty of manslaughter by the use of instruments upon the body of Janice Easterbrook, a pregnant woman, for the purpose of producing an abortion, in consequence of which said woman died. Section 559.100 RSMo 1949, V.A.M.S.
