PER CURIAM.

This appeal is submitted upon a clerk's transcript. Defendant was charged by Grand Jury indictment with the crime of breaking and entering, in violation of Section 708.8 of the 1958 Code of Iowa, I.C.A. Upon trial he was convicted by jury verdict and judgment and sentence were rendered thereon. He appeals his sentence of not to exceed ten years in the Iowa State Penitentiary at Fort Madison.
