Plaintiff was involved in an accident on October 28, 1958, while employed as a loader of pulpwood and was paid workmen's compensation. Dissatisfied with the weekly rate of $26 being paid him, he instituted this suit on March 26, 1959, for compensation at the maximum weekly rate of $35, and for penalties and attorney's fees, as provided in LSA-R.S. 23:1201.2.
