The litigation involved in this appeal was commenced in cause number 7477 in the District Court of Scurry County when Tri-Service Drilling Company, Inc., on July 22, 1958, brought suit against the West Texas State Bank to recover $67,000 which it alleged the bank had taken from its account without authority and loaned to Bel-Aire Pipeline Contractors.
